5.12.1 Bylaw 12 - Amateurism
General Principles
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.01 for ensuring the institution adheres to the NCAA's general principles regarding amateurism.
2.0 POLICY
The policy of The University of Texas is that student-athletes should be amateurs and that the institution shall maintain the athletics program as an integral part of the educational program.

6.0 PROCEDURE
6.1 By August 15 of each academic year, the Compliance Coordinator (CC) reviews Bylaw 12 for any legislative changes.
6.2 The CC educates student-athletes and staff and make alterations to any forms as required by the legislative changes, if any.
Definitions and Applications
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.02 for ensuring the institution adheres to the NCAA's definitions and applications regarding amateurism.
2.0 POLICY
The policy of The University of Texas is that student-athletes should be amateurs and, therefore, student-athletes (a) should not be paid for, or as a result of, their participation in athletics and (b) should not participate on professional teams.

6.0 PROCEDURE
6.1 By August 15 of each academic year, the Compliance Coordinator (CC) reviews the General Principles for any legislative changes.
6.2 The CC educates student-athletes and staff regarding the changes and makes any alterations to the forms required by the legislative changes.
6.3 In the absence of the CC, the Compliance Assistant (CA) is responsible for assuming the duties under this policy and procedure.
Amateurism Clearinghouse
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.1 for ensuring the institution and its student-athletes adhere to the NCAA's Amateurism Clearinghouse process.
2.0 POLICY
The policy of The University of Texas is to ensure that all prospective student-athletes enrolling for the first time at an NCAA institution have been certified as amateurs by the NCAA Amateurism Clearinghouse, and that the institution, its coaches and staff assist in this process as appropriate.

6.0 PROCEDURE
6.1 The Compliance Coordinator (CC) regularly educates coaches and staff regarding the requirements for registering for the NCAA Amateurism Clearinghouse and any changes to the registration process.
6.2 The coaches and their staffs educate the prospects they are recruiting about the NCAA Amateurism Clearinghouse requirements.
6.3 The CC tracks the Amateurism Clearinghouse status of the institution's prospective student-athletes on the NCAA Initial-Eligibility Spreadsheet.
6.3.1 The CC updates the spreadsheet weekly between March 1 and the beginning of the fall term.
6.3.2 The CC updates the spreadsheet weekly for any mid-year enrollees between November 1 and the beginning of the spring term.
6.4 The CC consults with the appropriate head coach regarding any prospective student-athlete whose certification status shows as "preliminarily not certified," "preliminarily certified with conditions," "not certified," or "certified with conditions."
6.5 The CC works with the appropriate coach and prospective student-athlete on any appeals of findings or determinations by the NCAA Amateurism Clearinghouse.
Amateur Status of Current Student-Athletes
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.1.2 by which the institution annually ensures that it and its returning student-athletes meet the NCAA standards for amateurism.
2.0 POLICY
The policy of The University of Texas is to ensure that its student-athletes meet the NCAA standards of amateurism.

6.0 PROCEDURE
6.1 Gambling, Agents and Amateurism Form
6.1.1 Each student-athlete completes a Gambling, Agents and Amateurism Form on SAS annually.
6.1.2 The Compliance Coordinator (CC) or Compliance Assistant (CA) reviews the SAS amateurism form and notes any occasion where a student-athlete has answered Yes to any of the Yes or No questions on the form.
6.1.3 If necessary, the CC or CA generates a list of follow-up questions for the student-athlete to obtain additional information regarding any Yes responses on the form.
6.1.4 The CC or CA reviews any follow up questions with the student-athlete.
6.1.5 The CC or CA inputs notes regarding follow-up questions into the "staff notes" section of SAS.
6.2 Other Inquiries
6.2.1 If any coach, student-athlete or other individual has a question about the amateur status of a student-athlete, the individual should submit an Interpretation Form to Compliance.
6.2.2 The CC reviews the request and provides a response within two business days.
Amateur Status of Current Incoming Student-Athletes
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.1.2 et seq. for ensuring the institution and its incoming student-athletes meet the NCAA standards for amateurism

6.0 PROCEDURE
6.1 Prospective Student-Athlete Questionnaire
6.1.1 The Compliance Coordinator (CC) takes the list of NLI signees and sorts each signee by sport, noting if any student-athletes are international, saving the list under Bylaw 12-Bylaw 12.1-PSA Questionnaires as PSA questionnaire list [academic year].
6.1.2 The CC gives the academics office a copy of the PSA questionnaire to mail out with all other correspondence included in each signee's packet.
6.1.3 As the PSA questionnaires come in, the Compliance Assistant (CA) notes receipt of the PSA questionnaires on the PSA questionnaire list and any issues to follow-up on with each individual.
6.1.4 The CA reviews any follow up questions with the student-athlete.
6.2 Student-Athlete System Forms
6.2.1 The prospect arrives on campus and completes their Student-Athlete System (SAS) paperwork.
6.2.2 Once the student-athlete completes their SAS paperwork, the CA checks the student-athlete's Gambling, Agents and Amateurism form and General Amateurism and Eligibility - International form on the SAS system.
6.2.3 If the incoming student-athlete indicates they are international, the CA issues a General Amateurism and Eligibility Form for International Student-Athletes to the individual.
6.2.4 The CA reviews the SAS amateurism form and General Amateurism and Eligibility Form for International Student-Athletes and generates a list of follow-up questions for the student-athlete.
6.2.5 The CA reviews any follow up questions with the student-athlete.
6.2.6 The CA inputs notes regarding follow-up questions into the "staff notes" section of SAS
6.3 Outside Team Participation
6.3.1 If the incoming student-athlete participated on any team prior to enrolling that may trigger the NCAA definition of a professional team, the CA will send the Outside Team Questionnaire to verify the amateur status of the team.
6.4 Reinstatement
6.4.1 In the event that reinstatement is required for any student-athlete as a result of the review of amateurism issues, the CC works with the student-athlete and the appropriate coach to seek reinstatement from the NCAA.
6.5 Other Inquiries
6.5.1 Any coach, student-athlete or other staff member who has a question relating to the amateur status of an incoming student-athlete should submit an Interpretation Form to Compliance.
6.5.2 The CC reviews the request and provides a response.
Correspondence from Agents
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.2 by which the institution ensures that its student-athletes do not participate in outside competitions that could possibly jeopardize their amateur status.
2.0 POLICY
The policy of The University of Texas is to ensure that its student-athletes meet the NCAA standards of amateurism.

6.0 PROCEDURE
6.1
6.1.1 If a student-athlete wishes to participate in a tournament or on an outside team, the student-athlete must complete and submit an outside competition approval form.
6.1.2 The Compliance Coordinator (CC) reviews the Outside Competition form within 48 hours to ensure the competition will not jeopardize the amateur status of the student-athlete.
6.1.3 The Director of Compliance (DOC) reviews the request to ensure the student-athlete will not jeopardize their eligibility in accordance with Bylaw 14.7.
6.1.4 The DOC sends an e-mail to the student-athlete, with a copy to the appropriate head coach, stating whether the outside competition is approved or denied.
6.1.5 If the outside competition involves an outside team and the assistant compliance coordinator is unable to verify the amateur status of the team, the assistant compliance coordinator sends an Outside Team Questionnaire to the team to verify the amateur status of the team.
6.2 Other Inquiries
6.2.1 If any coach, student-athlete or other individual has a question about the outside competition, the individual should submit an Interpretation Form to Compliance.
6.2.2 The Assistant Compliance Coordinator reviews the request and provides a response within business days.
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.3 and the State of Texas laws for ensuring correspondence from agents to all student-athletes are permissible.
2.0 POLICY
The policy of The University of Texas is to adhere to the laws of the State of Texas and the rules of the NCAA regarding contact between agents and student-athletes. The University seeks to protect the eligibility of its student-athletes and to serve the needs of student-athletes and the agents who seek to represent them once their collegiate eligibility has been completed.

6.0 PROCEDURE
6.1 In accordance with Texas state law, agents registered with the Texas Secretary of State may send correspondence directed to student-athletes to the Compliance Coordinator (CC).
6.2 The CC reviews the correspondence to ensure that nothing is being offered or provided in the correspondence that would violate NCAA rules or Texas state law.
6.3 The CC scans and saves copies of the correspondence in the folder P:\Compliance\[Academic Year]\Bylaw 12 - Amateurism\Bylaw 12.3-Use of Agents\Copies of letters & materials to SA's from agents.
6.4 The CC sends the correspondence to the student-athlete's head coach, or the director of operations for the sport, for distribution to the student-athlete.
6.5 If any student-athlete, coach or other individual has a question regarding the use of agents, that individual should submit an Interpretation Form to Compliance
6.6 The CC reviews the request and provides a responds within two business days.
Use of Agents
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.3 and the State of Texas laws for student-athletes and agents.
2.0 POLICY
The policy of The University of Texas is to adhere to the laws of the State of Texas and the rules of the NCAA and provide both the student-athlete and the agents with specific guidelines to follow. The University seeks to educate its student-athletes in how to protect their eligibility and serve the needs of student-athletes and the agents who seek who to represent them once their collegiate eligibility is completed.

6.0 PROCEDURE
6.1 The University of Texas at Austin designates a five-day period in both the fall term and spring term for student-athlete/agent interviews. The fall term will be for baseball, golf, tennis, track, swimming, rowing, and softball. The spring term will be for football, basketball, soccer, and volleyball.
6.2 Compliance notifies each agent registered with the State of Texas of the scheduled interview dates thirty days in advance.
6.3 Compliance conducts on-campus interviews.
6.4 Compliance invites eligible student-athletes to participate in the agent week. Those agents indicate their interest in attending will be sent this list. Each agent selects those student-athletes he/she would like to interview. The student-athletes provide the names of those agents who have expressed a desire to interview with them. After the student-athlete has chosen which agents he/she wishes to interview with, Compliance schedules the interviews and provide both the student-athletes and the agents the date, time and location of the interview.
6.5 The interviews will take place in the presence of a third-party designated by Compliance.
6.6 Compliance annually submits the University's Student-Athlete Agent policy to the Secretary of State.
6.7 Compliances organizes and supervises the student-athlete/agent interview policy to ensure the compliance of the student-athletes/agents with the State of Texas Athlete Agents Act and any rules adopted under the Act as well as NCAA legislation.
6.8 Compliance provides the student-athletes and the registered agents with a copy of the institution's Student-Athlete Agent Policy.
6.9 If any student-athlete, coach or other individual has a question regarding the use of agents that individual should submit an Interpretation Form to Compliance.
6.10 The CC reviews the request and provides a response within 48 hours.
Student-Athlete Appearance Request
1.0 PURPOSE
This policy establishes guidelines pursuant to NCAA Bylaw 12.5 by for ensuring the institutions and its student-athletes do not participate in promotional or charitable activities that might jeopardize their amateur status.
2.0 POLICY
The policy of The University of Texas to ensure that its student-athletes are permitted to participate in any educational, charitable or promotional activities that are permissible under NCAA rules and do not interfere with their academic obligations.

6.0 PROCEDURE
6.1
6.1.1 The organization requesting a student-athlete appearance submits the Student-Athlete Appearance form to the student services assistant.
6.1.2 The student services assistant obtains signatures from the coaching staff, student-athletes, and academics staff.
6.1.3 The student services assistant forwards the form to the Compliance Coordinator (CC) who evaluates whether the appearance will be permissible. The CC either approves or denies the request and returns the request to the student services assistant. In reviewing the form, the Assistant Compliance Coordinator reviews the following:
6.1.3.1 Verify that the entity requesting the appearance is a charitable, educational, nonprofit or University of Texas entity.
6.1.3.2 Verify that any expenses to be provided are appropriate to the appearance.
6.1.3.3 Verify that the student-athletes will not receive anything in excess of actual and necessary expenses.
6.1.3.4 Determine whether the event will involve any prospective student-athletes.
6.1.3.5 Verify that the appearance does not involve any impermissible commercial co-sponsors.
6.1.4 The student services assistant contacts the requestor notifying them of the approval or denial and if necessary, forwards any logistics to the participating student-athletes.
6.1.3 The student services assistant follows up with the organization and/or student-athletes to determine if there were any problems during the appearance.
6.2 Other Inquiries
6.2.1 If any coach, student-athlete, or other individual has a question about a student-athlete appearance request, the individual should submit an Interpretation Form to Compliance.
6.2.2 The CC reviews the request and provides a response within two business days.
