5.10.1 Bylaw 10 - Ethical Conduct

Ethical Conduct

1.0 PURPOSE

This policy establishes guidelines pursuant to NCAA Bylaw 10.1 for ensuring that employees and student-athletes conduct themselves in compliance with NCAA, Big 12 Conference, and institutional regulations.

2.0 POLICY

The policy of The University of Texas at Austin is that compliance with the rules and regulations of the Board of Regents of the University of Texas System, the University of Texas at Austin, the NCAA, the Big 12 Conference and any other governing body, by all members of the athletics department staff and all student-athletes is of paramount importance to the University. It is the expectation of the University that all employees and student-athletes will conduct themselves in full compliance with all such rules and regulations and in accordance with the University's established tradition of integrity and ethical conduct.

It is the policy of The University that if the relevant athletics director determines that an employee or student-athlete is in violation of the rules and regulations of the Board of Regents of the University of Texas System, the University of Texas at Austin, the NCAA, the Big 12 Conference or any other governing body, the employee or student-athlete may be subject to disciplinary or corrective actions as appropriate under the applicable rules, regulations bylaws, policies or constitution.

It is the policy of the University that in the event that an employee or student-athlete becomes aware, or has reasonable cause to believe, that violation(s) of the constitutions, bylaws, interpretations, rules or regulations of the University, the Big 12 Conference or the NCAA may have taken place, he or she shall report the same promptly to the appropriate Athletic Director.

6.0 PROCEDURE

6.1 The University includes an obligation to adhere to the institution's standards of integrity and ethical conduct in all athletics departments' job descriptions.

6.2 The Compliance Assistant (CA) oversees of the University's efforts to ensure compliance with the institution's standards of integrity and ethical conduct, under the supervision of the Associate Athletics Director for Compliance.

6.3 The CA discusses the obligation to maintain the University's standards of integrity and ethical conduct in at least one all staff educational session each year.

6.4 The CA educates all staff and student-athletes on an annual basis regarding methods for reporting suspected violations of the rules and regulations of the Board of Regents of the University of Texas System, the University of Texas at Austin, the NCAA, the Big 12 Conference and any other governing body.

6.5 The CA educates all student-athletes about the obligation to maintain the University's standards of integrity and ethical conduct at each beginning-of-the-year and end-of-the-year educational session.

6.6 The CA educates all student-athletes regarding ethical conduct standards pursuant to NCAA Bylaw 10.1 when completing any beginning-of-the-year compliance forms.

6.7 Pursuant to Bylaw 10.1, all staff and student-athletes are reminded their ethical conduct obligations if they are asked to provide information in the course of an investigation of a possible violation and at annual education meetings.

6.8 Staff and student-athletes sign an acknowledgement of their ethical conduct obligations when asked to provide a written statement related to such investigation.

General Principles

1.0 PURPOSE

This procedure establishes guidelines pursuant to NCAA Bylaw 10.1 for monitoring honesty and sportsmanship.

2.0 POLICY

The policy of the University of Texas at Austin that its intercollegiate athletics program will exemplify the honor and dignity of fair play and the generally recognized high standards associated with wholesome competitive sports. It is the expectation of the University that all employees and student-athletes will conduct themselves with honesty and sportsmanship at all times.

6.1 The Compliance Coordinator (CC) is responsible for oversight of the University's efforts to ensure compliance with the institution's standards of integrity and ethical conduct, under the supervision of the Associate Athletics Director for Compliance.

6.2 The CC educates all staff and student-athletes on an annual basis regarding the institution's expectations regarding honesty and sportsmanship.

Knowledge and Use of Banned Drugs

1.0 PURPOSE

This procedure establishes guidelines pursuant to NCAA Bylaw 10.2 for reporting suspected drug use of a student-athlete by an athletics staff member.

2.0 POLICY

The policy of The University of Texas is that any staff member must report the use, or suspected use of any banned performance enhancing substances or non-therapeutic drugs by any student-athlete to the appropriate athletic director.

6.0 PROCEDURE

6.1 The Compliance Coordinator (CC) ensures that all athletics department staff are educated on an annual basis regarding their obligation to report suspected drug use by student-athletes to the athletics directors.

6.2 Any suspected drug use reported to the athletics directors is investigated as appropriate. If appropriate, the athletics directors refer the relevant student-athlete for treatment in accordance with the institution's Drug Education and Testing Policy.

Gambling Activities

1.0 PURPOSE

This procedure establishes guidelines pursuant to NCAA Bylaw 10.3 for educating athletics staff members and student-athletes regarding gambling activities.

2.0 POLICY

The policy of The University of Texas at Austin is that staff members and student-athletes shall not knowingly engage in gambling activities involving any sport sponsored by the NCAA. Gambling activities include betting on or soliciting bets for any item of value on any sports competition, at the college, professional or any other level, on any sport sponsored by the NCAA. Gambling activities also include providing information or assistance to any individual involved in gambling activities, including but not limited to bookmakers, online gambling web sites, or any form of organized gambling.

6.2 The CC educates the athletics department staff at least once annually regarding the institution's policy on gambling activities.

6.3 The CC educates all student-athletes about the institution's policy on gambling activities at each beginning-of-the-year and end-of-the-year educational session.

6.4 The CC requires all student-athletes to affirm that they have not participated in gambling activities on their beginning-of-the-year compliance forms.
